Port Displeased by Being Added to Bay Cleanup Order

The agency supports the action, which involves a massive San Diego Bay dredging, but maintains it should not have been included in regulatory order.

The Port of San Diego Board of Commissioners has voted unanimously to appeal its inclusion in by the San Diego Regional Water Quality Control Board.

The port has maintained that it did not cause the pollution near shipyards and Naval Station San Diego that is subject of the cleanup order issued on March 14.

The port tried unsuccessfully to keep out of the ruling, which calls for the dredging of 143,400 cubic yards of sediment from roughly 60 acres of bay bottom. The scope is three times larger than previous cleanups.

Environmental organizations say fish caught in the bay may not be safe to eat because of the pollution.

According to port officials, the commissioners support the order, just not their inclusion. Thus, their appeal does not seek to stop or delay the remedial action.

The port contends in the appeal that it is a public trustee of the bay, so being included in the cleanup order is an abuse of the water board's discretion and a violation of public policy.
