Restraining Orders Issued in Nicky Rottens Dispute

A neighbor who owns property behind the restaurant seeks court's intervention after a confrontation with the restaurant's former owner and his father.

A neighbor and a former owner of Coronado's Nicky Rottens outlet continue to do battle.

Tom Wucherer, 49, who owns a condominium behind the Orange Avenue restaurant, has sought and was granted a restraining order against Nick Tomasello, 34, who opened the eatery with a partner in September. 

The order will be in place for one year following the March 1 civil hearing in San Diego Superior Court. In an earlier hearing, Wucherer requested, and was granted, a restraining order against Dominico Tomasello, 60, Nick Tomasello's father.

Father and son must stay 50 yards from Wucherer, his wife, two minor children and a cousin. 

Wucherer is a part-time resident of Coronado. His primary residence is Las Vegas. Tomasello and his father live in San Diego.

The sale followed a heated dispute with Wucherer and dual allegations of harassment, threats and use of pejorative terms during a December confrontation outside the restaurant.

Wucherer filed a police report following the incident, and the case was forwarded to the District Attorney's Office, which declined to file charges, according to Coronado police Chief Louis Scanlon.

Aaron was present at the scene, but Wucherer did not seek a restraining order against him.

The enmity is linked to residual neighborhood anger over the opening of the restaurant, and the city's handling of permits required for the business.
